Environmental issues are a special focus of our energy regulatory practice. We conduct environmental due diligence critical in this era of acquisitions, divestitures and industry combinations. We then effectively negotiate and allocate those liabilities. Our attorneys counsel clients regarding interpretation and implementation of environmental legal requirements that may affect their daily operations.
We are experienced in preparing compliance, auditing and environmental risk management policies and procedures. When accidents or discovered releases occur, we coordinate environmental response actions that meet the requirements of the Oil Pollution Act, Superfund, Railroad Commission of Texas rules and other federal and state regulatory agencies.
We assist if an accident involves threats of enforcement from citizens or regulatory authorities, cost recovery, contributions, personal injury or property damage claims for pollution. For energy clients needing to obtain permits or other authorizations from regulatory authorities, we negotiate terms and conditions that allow operational flexibility. We also help to navigate the difficulties associated with citizen protests and contested case hearings.
